1. About these terms

These Terms of Service govern your use of emberworkscreative.com (the “Site”) and any free or paid resources you get from it, such as checklists, guides, templates, and other downloads (“Resources”). The Site is operated by Emberworks Creative, LLC, a Utah limited liability company (“Emberworks,” “we,” “us”).

By using the Site, signing up for a free Resource, or buying a Resource, you agree to these terms. If you’re agreeing on behalf of a business, you confirm you’re authorized to do so, and “you” includes that business.

2. Using the Site

You may use the Site for lawful purposes only. You agree not to:

Interfere with the Site’s security or operation, or try to access areas, files, or systems you’re not authorized to use
Use automated tools to scrape, copy, or download content from the Site in bulk
Submit false information, or sign up using someone else’s email address
Use the Site to send spam or harmful content

3. Agency services

Video production, advertising, branding, web design, and other services we provide to clients are governed by a separate written agreement between us and that client. These terms don’t create a client relationship or obligate us to provide any services. If a signed services agreement conflicts with these terms, the services agreement controls for those services.

4. Buying Resources

Prices and payment. Prices are listed in U.S. dollars on each product page. Payments are processed by Stripe, Inc. We never see or store your full card number. Applicable sales tax may be added at checkout.

Promo codes. Promo codes apply only to the products and periods we specify, have no cash value, and can’t be combined unless we say so. We may end a promo code at any time, but we’ll honor any code applied to a completed purchase.

Delivery. Resources are digital downloads. After payment, you’ll get a download link on screen and by email. Download links stay active for 30 days, so please save your file. If you have trouble downloading, email us at hello@emberworkscreative.com and we’ll help.

Refunds. If a Resource isn’t useful to you, email us within 14 days of purchase with your order email and we’ll refund you in full. No explanation needed. See our Refund Policy for how to ask.

We may refuse or cancel an order if we suspect fraud, abuse, or a pricing error. If we cancel a paid order, we’ll refund you in full.

5. Your license to Resources

The Site and all Resources, including text, design, templates, and images, are owned by Emberworks and protected by copyright and other laws. Buying or downloading a Resource gives you a license to use it. It doesn’t transfer ownership.

What you can do. We grant you a non-exclusive, non-transferable license to use each Resource for the internal business purposes of one business, which is the business that bought or signed up for it. Within that business, you can:

Print copies and share them with your own employees and contractors
Use the templates to write your own review requests, descriptions, posts, and other materials, and publish what you create from them

What you write using our templates belongs to you.

What you can’t do. Without our written permission, you may not:

Resell, sublicense, or give away a Resource, or share it with other businesses
Post a Resource, or substantial portions of it, publicly or anywhere others can download it
Use a Resource to deliver services to clients, for example as an agency or consultant, or include it in a product, course, or membership
Remove our copyright notices or branding

If you’d like to use a Resource with clients or across several businesses, email us about a broader license.

6. Disclaimers

No affiliation with Google or other platforms. Emberworks is not affiliated with, endorsed by, or sponsored by Google, Meta, or any other platform our Resources discuss. Google Business Profile and other product names are trademarks of their owners. Platforms change their features, rules, and processes often, and we can’t guarantee our Resources reflect every change.

No guaranteed results. Resources contain general educational information. Results depend on your market, competitors, effort, and decisions by platforms we don’t control. We don’t promise any ranking, number of calls, reinstatement of a suspended profile, or other outcome.

Not professional advice. Resources aren’t legal, tax, insurance, or financial advice. Talk to a qualified professional about your specific situation.

As-is. To the extent the law allows, the Site and Resources are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of liability

To the extent the law allows, Emberworks won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising from your use of the Site or Resources. Our total liability for any claim relating to the Site or a Resource is limited to the amount you paid us for that Resource, or $50 if you didn’t pay anything.

8. Indemnity

You agree to cover any claims, losses, and reasonable legal fees we incur because you broke these terms or misused a Resource.

9. Governing law

These terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Utah County, Utah, and you and we both consent to those courts’ jurisdiction.

10. Changes and contact

We may update these terms from time to time. The “Last updated” date shows when they last changed. Changes don’t affect purchases you’ve already completed.

If any part of these terms can’t be enforced, the rest stays in effect. These terms, together with our Privacy Policy, are the entire agreement between you and us about the Site and Resources.
